II - Scope & Application of the Terms of Service
These General Terms of Service (TOS) define the rights and contractual obligations of the Parties involved in the sale of Products on the Website suzelparis.com. They apply exclusively, without restriction or reservation, to any order placed on the Website.
The Website's Legal Notice and Privacy Policy form an integral part of these Terms. SUZEL reserves the right to modify these Terms at any time and without prior notice, notably to comply with legislative, jurisprudential, and/or technical developments. The updated Terms will be made available on the Website for Customer consultation and will apply immediately to any subsequent orders.
Any order placed on the Website is strictly conditioned upon the prior consultation and unreserved acceptance of the Terms and applicable prices. The validation of an order, according to the procedure defined on the Website, constitutes full acceptance of these Terms, as well as the associated rates, taxes, and shipping fees. SUZEL reserves the right to refuse any Order in the event of a breach of these Terms.
III - Definitions
Product: Any item offered for sale on the Website suzelparis.com that a customer may legally order.
Customer: Any non-commercial and non-professional individual placing an order as a consumer, holding full legal capacity to contract.
Order: The electronic process by which the Customer selects the products they wish to purchase via the e-commerce infrastructure of suzelparis.com and pays the total amount due to the seller, SUZEL.
Contract: These Terms of Service and any associated order confirmations.
Parties: Refers jointly to SUZEL and the Customer.
Website: The e-commerce infrastructure developed by SUZEL, accessible at www.suzelparis.com, containing texts, audio, images, videos, product sheets, and databases.
IV - Products & Availability
The items offered for sale are those listed on the Website on the day of consultation by the Customer, subject to stock availability. SUZEL reserves the right to withdraw any item from sale at any time, and/or to replace or modify any descriptions, visuals, or information associated with items appearing on the Website.
Stock availability indicators are updated automatically. However, any error in the update process, regardless of its origin, shall not engage the liability of SUZEL. As such, SUZEL cannot be held liable for the cancellation of an order due to stock depletion. In the event that an item becomes unavailable after an order has been finalized, the Customer will be notified via email, and the order will be automatically cancelled. SUZEL undertakes to inform the Customer as soon as possible and to refund the full amount paid within fourteen (14) calendar days.
The characteristics of items sold on the Website (photographs, graphics, product descriptions, etc.) may vary over time. Only the product characteristics explicitly displayed at the exact moment of order validation shall be contractually binding. In the event of errors or omissions in a product description, SUZEL's liability is strictly limited to reimbursing the reasonable return shipping costs incurred by the Customer.
Customers are informed that they may occasionally receive a piece that was previously returned by another individual. SUZEL exclusively accepts the return of brand new, unworn, unwashed, and undamaged items, which undergo rigorous quality control before being restocked.
V - Customer Account Creation
To place an order on the Website, the Customer must first create a personal account containing their identification and delivery data (the "Account"). Account creation is strictly reserved for individuals acting as consumers, aged 18 or older, and possessing full legal capacity. Registration is validated by SUZEL after verification of the standard form completed by the Customer. The Customer will receive a confirmation email upon successful registration.
The Customer is solely responsible for the completeness, accuracy, and truthfulness of the information provided during Account creation and commits to updating it immediately. SUZEL shall not be held liable for the impossibility of delivering items due to incorrect or incomplete contact details provided by the Customer.
The chosen login ID (email address) and password are strictly personal and confidential. The Customer is entirely responsible for safeguarding these credentials and must not disclose them to third parties under any pretext. In case of suspected unauthorized use of the account, the Customer must immediately alert SUZEL to change their password or close the Account.
SUZEL reserves the right to deactivate or close any Customer account, and consequently refuse any sale, in the following cases:
- Outstanding or unpaid balances from one or more prior orders;
- Abusive, unfair, systematic, or fraudulent use of the ordering service, or non-compliance with any obligation defined in these Terms;
- Orders clearly validated by a Customer acting as a professional reseller or commercial entity.
VI - Orders & Contract Formation
Placing an order implies a strict obligation to pay. The Customer declares to be the legitimate holder of the account used for the purchase and assumes sole responsibility for selecting the Products and assessing their suitability for their needs.
The retail infrastructure of suzelparis.com is strictly reserved for individual consumers. No orders may be placed by professional resellers or commercial intermediaries, whether acting individually or collectively. The Customer acknowledges that items may only be purchased in quantities matching the typical personal needs of a standard consumer. SUZEL reserves the right to refuse or cancel any order that manifestly indicates commercial reselling or wholesale patterns.
The shopping Cart summarizes the items selected, their prices, and any applicable shipping fees. The Customer can freely modify the Cart before validating the final step. Following payment authorization, SUZEL sends an order confirmation email. The contract is definitively concluded only upon receipt by the Customer of an email confirming the actual shipment of the items.
Customers may request an official invoice by sending an email specifying the order number to sav@suzelparis.com. SUZEL cannot be held liable for entry errors or data transmission failures that prevent the delivery of confirmation emails or items.
VII - Pricing & Taxes
Product prices are indicated on the Website in Euros (€), inclusive of French Value Added Tax (VAT), but strictly exclude:
- Customs duties, import taxes, local sales taxes, or carrier clearance fees, which are the sole responsibility of the Customer and must be paid directly to the carrier upon entry into the destination country (e.g., USA or other non-EU countries);
- Shipping and delivery fees, which are specified before final order validation under the "Shipping & Returns" section;
- Currency conversion fees or international transaction bank charges applied by the Customer's banking institution.
SUZEL reserves the right to modify product prices at any time. Items will be invoiced based on the rates in effect at the exact moment of order validation. No refunds or price adjustments for differences resulting from subsequent promotional discounts or markdown cycles after order validation will be granted.
In the event that an abnormally low or derisory price is displayed due to a technical or human error (pricing glitch), SUZEL reserves the right to cancel the Order, even if automatically confirmed, and will issue a full refund of any sums already paid.
For all shipments outside the European Union (including the United States and Asia), prices are displayed exclusive of tax. Please note that customs duties, local taxes, and applicable Sales Tax are the sole responsibility of the customer. These charges must be paid directly to the carrier upon delivery (DDU - Delivered Duty Unpaid).
VIII - Payment Terms & Security
Items are payable in full at the time the order is validated. Payments can be securely executed via PayPal or via Credit/Debit Card (Visa, Mastercard, Carte Bancaire) processed through a secure online payment platform.
Providing credit card data constitutes an irrevocable authorization to debit the Customer's account for the total price of the ordered items. In case of payment rejection or failure, the order will be automatically cancelled. The digital logs recorded and stored by SUZEL, PayPal, and Shopify constitute valid and definitive proof of all commercial and financial transactions.
IX - Shipping, Delivery & Risk Transfer
Delivery is defined as the transfer of physical possession of the items to the Customer. The risk of loss or damage to the products is transferred to the Customer at the exact moment of Delivery.
Standard delivery is provided via Colissimo (tracked delivery – without signature). Shipping fees are detailed before checkout based on destination. Deliveries cannot be made to hotels or P.O. Boxes. It is the Customer's sole responsibility to provide accurate delivery details (access codes, intercom numbers, correct postal address).
If a delivery is impossible due to an incorrect shipping address provided by the Customer, no reshipment will be performed, and the Customer will be refunded within 14 days of SUZEL receiving the undelivered package back, via the original payment method, minus any standard processing or return costs where legally permitted.
SUZEL delivers orders within the timelines indicated on the Website, and at the latest thirty (30) days after order validation, excluding pre-ordered items. SUZEL cannot be held liable for delivery delays that are not of its own making or are justified by an event of Force Majeure (as defined in Article XII).
In case of a delay exceeding the delivery timeframe, the Customer may write to sav@suzelparis.com to agree on a reasonable additional delivery timeframe. If the Customer has still not received their order upon the expiration of this extension, they may cancel the sale by writing to sav@suzelparis.com and obtain a full refund of all sums paid within a maximum of 14 days. If the order had already been shipped at the time of cancellation, the Customer must return it to SUZEL to receive the refund. To do so, the Customer shall write to sav@suzelparis.com upon receipt to obtain a prepaid return label. Items must be returned in their original packaging, brand new, unworn, unwashed, and with all tags intact and attached. SUZEL cannot be held liable for any consequential damages resulting from a delivery delay; only the refund of the sums paid is possible, to the exclusion of any other form of compensation.
X - Returns, Right of Withdrawal & Refunds
International Return Policy Notice: In compliance with European consumer laws, all customers—including international and US buyers—benefit from a 14-day return period under the terms outlined below. This policy applies identically during official sale periods (soldes) and promotional events.
The Customer has a period of fourteen (14) calendar days starting the day after physical delivery to notify SUZEL of their intent to return an item. Beyond this 14-day period, the sale is considered final, and no returns can be accepted.
The Customer must communicate their decision to return either by email to sav@suzelparis.com or via the contact form available on suzelparis.com.
Return Shipping Logistics: Return shipping costs are entirely borne by the Customer, and items are shipped at the Customer's own risk via the carrier of their choice. The Customer must complete the official return form printable from the Website, place it inside the original packaging with the products, and ship the package within fourteen (14) days following the communication of their decision to return.
Return shipping is fully covered by SUZEL only in the event that the delivered item does not conform to the order or has a verified manufacturing defect. In this case, the Customer should write to sav@suzelparis.com to receive a prepaid return label.
Product Condition Requirements: In all cases, items must be returned in their original packaging, brand new, unworn, unwashed, undamaged, unslipped, and with all tags intact, attached, and unaltered.
Refund Process: The refund will be processed provided that SUZEL has successfully recovered and inspected the items. Once approved, SUZEL will refund the Customer for the total amount paid, including the original standard shipping costs, within 14 calendar days from the date of receipt of the return package, using the original payment method. Refunds are processed in Euros (€). Any additional costs related to currency conversion or international bank fees are the sole responsibility of the Customer.
Exchanges: This return and refund procedure excludes direct exchanges. To exchange an item, the Customer must perform a standard return for a refund and place a new order on the Website.
XI - Legal Warranties & Defect Claims (French Law)
The presence of any apparent defect or non-conformity on an item must immediately be reported via email to sav@suzelparis.com with explicit descriptions and photo evidence. Otherwise, no claim will be admissible.
Items must be returned in their original packaging, brand new, unworn, unwashed, and with tags intact, along with order references to SUZEL's registered address. Verified apparent defects will result, according to the Customer's preference, in a store credit, an item replacement, or a direct refund within 14 days. Non-compliance with the return procedure prevents any exchange or refund.
Furthermore, SUZEL guarantees consumers against conformity defects (Articles L. 217-4 et seq. of the French Consumer Code) and hidden defects (Articles 1641 et seq. of the French Civil Code) under French law:
Legal Warranty of Conformity: The Customer has a period of two (2) years from the delivery of the product to act; is exempt from providing proof of the existence of the conformity defect during the twenty-four (24) months following delivery; may choose between repair or replacement, subject to the cost conditions provided by law. If repair and replacement are impossible, the buyer can return the item for a full refund or keep it for a partial refund.
Legal Warranty Against Hidden Defects: The Customer may invoke the legal warranty for hidden defects within the meaning of Articles 1641 et seq. of the French Civil Code if a hidden defect, prior to the sale and inherent to the product, renders it unfit for its intended use or severely diminishes such use. This warranty allows the Customer, within two (2) years of discovering the defect, to either keep the item and request a price reduction or return it for a full refund. Normal wear and tear or misuse are excluded from this warranty.
XII - Limitation of Liability
Hyperlinks pointing to external third-party sites from suzelparis.com shall not engage the liability of SUZEL or its Publication Director.
SUZEL is solely liable for direct and foreseeable damages at the time of website use or the conclusion of the sales contract, to the exclusion of all indirect, incidental, special, punitive, or consequential damages. SUZEL's total liability with respect to any item purchased on the Website is strictly limited to the purchase price of that item. SUZEL shall not be held liable for any loss of income, loss of operation, loss of profits, loss of data, loss of business opportunity, moral prejudice, or image damage.
SUZEL does not guarantee that the Website or its hosting servers are free from viruses, trojan horses, or malware, and cannot be held liable for damages resulting from such digital threats. It is the Customer's responsibility to install appropriate antivirus and security software. The Customer assumes all risks related to downloaded content.
SUZEL cannot be held liable for any breach or delay resulting from an event of Force Majeure (such as strikes, lockouts, war, terrorist attacks, natural disasters, epidemics, or telecommunication network failures). Obligations are suspended for the duration of the Force Majeure event. If it exceeds three (3) months, either Party may terminate the transaction without indemnity. Non-payment cannot be excused by Force Majeure.
XIII - Customer Service
For any information, order tracking, or warranty claims, the Customer must contact Customer Service by completing the form on the "Contact" page of the Website or via email at: sav@suzelparis.com.
XIV - Personal Data Protection & Privacy
The Customer is informed and agrees that their personal data may be collected on the Website and processed by SUZEL, acting as the Data Controller, in compliance with applicable data protection regulations, including the European General Data Protection Regulation (GDPR 2016/679).
SUZEL undertakes to secure and protect the confidentiality of personal data, preventing unauthorized third-party access. The Website is hosted by Shopify Inc. Personal data is stored via Shopify's secure databases and infrastructure protected by firewalls. For EEA residents, data is processed by Shopify International Ltd (Ireland).
In the event of a data breach presenting a high risk to Customer rights, SUZEL will notify the competent authorities and the affected individuals. Data is shared with contractually bound subcontractors solely for order fulfillment (identity, address, phone, email).
Data is retained only as long as necessary: up to 3 years after the end of the commercial relationship for active customers, and 3 years from the last contact for prospects.
Credit card transactions are processed securely via PCI-DSS compliant gateways (Shopify/PayPal) using industry-standard encryption. Financial data is deleted once the transaction is completed. Customers possess rights of access, rectification, opposition, erasure, restriction, and portability regarding their data. XV - Commercial Marketing & Opt-Out
SUZEL may send Customers newsletters and promotional offers via email, SMS, or social media, subject to prior consent (opt-in). Customers can opt-out at any time free of charge by clicking the "Unsubscribe" link in any email, replying "STOP" to SMS, or emailing sav@suzelparis.com.
XVI - Cookies & Tracking Technologies
The Website uses cookies to facilitate navigation and recognize the Customer's browser. Cookies are only installed after the Customer's consent (except strictly necessary cookies). Customers can manage or block cookies through their browser settings, though this may impact website functionality. Third-party social media plugins (Facebook, Instagram, etc.) may track browsing data if the Customer is logged into those networks.
XVII - Intellectual Property & Website Use
The reproduction or representation, in whole or in part, of the Website's pages, designs, models, illustrations, or text without prior written authorization from SUZEL is strictly prohibited and constitutes copyright infringement under the Intellectual Property Code. The "SUZEL" and "SUZEL PARIS" trademarks, logos, and brand assets are exclusively owned by SUZEL. Unauthorized use is subject to civil and criminal liability.
XVIII - Severability
If one or more provisions of these Terms are held to be invalid or declared as such under any law, regulation, or final court decision, the remaining provisions shall retain their full force and scope.
XIX - No Waiver
No tolerance, inaction, or delay by SUZEL in enforcing its rights under these Terms shall be construed as a waiver of such rights.
XX - Governing Law, Dispute Resolution & Mediation
These Terms of Service are governed by and construed in accordance with French law, without giving effect to any principles of conflicts of law.
In the event of a dispute, the Customer should first contact SUZEL's Customer Service at sav@suzelparis.com to reach an amicable solution.
For European Union Consumers: In the event of an unresolved claim after two months, the consumer may submit the dispute free of charge to the approved consumer mediator, CM2C. Saisines can be made online at https://www.cm2c.net/ or by mail: CM2C, 49 Rue de Ponthieu, 75008 Paris, France. The European Commission also provides an Online Dispute Resolution (ODR) platform at http://ec.europa.eu/consumers/odr/.
For International Consumers (including United States Customers): To the maximum extent permitted by applicable law, any dispute regarding the execution, interpretation, or validity of these Terms, failing an amicable settlement, shall be submitted to the exclusive jurisdiction of the competent courts of France, notwithstanding the application of mandatory local consumer protection provisions where applicable by law.
